Research On Legal Matters Of Law Application Foreign-related Consumer’s Rights And Interests

With the growing trend of globalization, China integrate into the world economy gradually unified market, foreign-related consumption everywhere, along with consumer disputes also increase significantly. This article is based on research of foreign consumer protection rules applicable issues, from the definition of foreign-related consumers, to protect the interests of the weak foreign-related consumers cut, a more comprehensive study of the application of specific laws on consumer protection and constantly improve certain reference. This article is divided into four parts, the first part focuses on the basic concepts of foreign-related consumer protection, relative to the operators, legal persons and other organizations, consumers are weak, disadvantaged, special protection should be given; the second part focuses on the conflict of laws of foreign-related consumer protection, including the consumers who need to be protected, protection of the object, the applicable law and other aspects the conflict, between an individual jurisdictions within countries, because of their civil law have different rules for the same problem, when the case of the foreign-related elements in case of problem obtains conflict of laws, so as consumer protection; the third part focuses on solving conflicts of foreign-related consumer protection, starting with start with general principles of law, including the principle of autonomy, the most closely related principle, to protect the interests of the weak application of the principle that consumers as a typical representative of the weak party, the private international law is with a special standards to value the interests of the parties a. Research in other countries through foreign consumer protection laws and regulations applicable to the better-depth consumer protection laws apply to foreign issues; and finally focus on foreign consumer protection laws applicable regulations to improve the provisions of domestic law to protect the interests of foreign-related consumers.
