Study On The Legal Issues Of Rural Land Trust

With the developing of society and economy of our nation, the problem of rural land is becoming more and more serious. The family-based contracted responsibility system has led to fragmentation of land management, which cause low income and a mass phenomenon of land abandon. To adapt the development of modern agriculture and raise the economy standard of rural area, many efforts of land transfer of different places has been made. This thesis aims at analyzing the feature and risk of rural land trust with a method which combines theory and practice. This thesis includes three parts:introduction, main body and conclusion.The introduction part mainly introduces the social background of this thesis, and questions to be solved in this thesis.The main body of this thesis includes four Chapter. Chapter 1 mainly discusses the theoretical basis of land trust, from the perspective of the existing legal provisions on rural land and the basic theory of trust. Chapter 2 mainly introduces the practical foundation of land trust, in particular, a summary of experiences of land transfer of our nation recent years and the pattern of land trust of other nations is included. Chapter 3 takes YiYang and Shaoxing for example to demonstrate the features of land trust of our nation. Chapter 4 mainly discusses ways to improve the land trust system.The conclusion part of this thesis summarizes the analysis and demonstration of the main body and defines the attitude towards land trust, and explains the shortage on study of this thesis.
