The Basic Logic Of Knowledge-Jurisprudence

This paper is based on the historical perspective of development of jurisprudence latest half century, to explore deeply discourse hegemony on Modernization Paradigm, through interpreting the critical thinking of four typical theories on Chinese jurisprudence by Deng Zhenglai, analyzing that Chinese jurisprudence is controlled by Modernized Model from timeline and category.This paper will make a detailed inquiry about Legitimacy of Chinese jurisprudence from the comprehension on Modernization and legitimacy, and then explain the two stages of disposition, accordingly, put forward the ideal prospect after realizing the imperfection of Chinese jurisprudence.Epistemologically speaking, this paper will analyze the related theory of knowledge to put forward the function of citation on the realism, and analyze the rationality and imperfection on theory of "knowledge-jurisprudence" to come up with the possibility of the ambition prospect of Chinese jurisprudence, accordingly, find out a way of subjectivity.In the deeper sense, the autonomy of Chinese jurisprudence is the issue that should be focused on. We will find the point is to rediscover China and Chinese jurisprudence when we build ambition prospect through relation and globalization view. The development direction of jurisprudence is to build the jurisprudence with Chinese subjectivity. Only then can we lead the legal system construction to the high level.
