| Constructions are the material basis of human survival and development. In recent years, construction quality accidents have been occurring often, giving people bitter lessons. Const-ruction quality has become a social hotspot. Responsibility investigation shall be an important task once construction quality accidents happen. There are currently many laws and regulat-ions on constructions, for example, Construction Law, Housing Construction Project Quality Regulation and Construction Project Quality Management Ordinance. But these laws and regulations are contradictory without clear-cut responsibilities and are not systematic enough. These problems urge us to improve the current laws and regulations on constructions to adapt them to the demand of the time. When construction quality accidents happen, there must be law’s to abide by. And the responsibilities must be clear to protect every participant. Thus, legitimate rights and interests of individuals shall be protected by laws, the persons liable shall be punished and construction quality can be improved. Among studies on construction quality responsibilities of Chinese Theorists, there are not many articles. And the ones ex-isting are not comprehensive and thorough enough. So we should commence from theories and practices of construction quality responsibilities. And enhance legal systems of const-truction quality responsibilities with the help of practices while studying theories of cons-truction quality responsibilities, striving to offer guidance and suggestions in legislation, impioving China’s management system of construction quality. As China gradually prospers and its economy unceasingly grows, the number of construction projects increases day by day. Their qualities are the keys to China’s stability, prosperity and stability of people’s lives as well as the fundamental tasks of Chinese construction industry.This thesis is divided into four parts:The first part mainly elaborates general concepts of the definitions and qualities of construction projects and the differences between constru-ction projects and building projects. Meanwhile, this part points out the differences between construction quality and qualities of other products. The second part illustrates the constru-ction quality responsibilities which can be divided into civil liabilities, administrative liabi-lities and criminal liabilities. This thesis mainly focuses on civil liabilities. The third part points out the current defects in Chinese legal systems of construction quality responsibilities which mainly include legislative style, term of service, insurance system and prescribed period for litigation. In the fourth part the writer illustrates his views on perfecting Chinese legal systems of construction quality responsibilities, concentrating on existing problems. |
