Since the beginning of21stcentury, the Internet industry has gone through arapid development and become an important part of the economic growth of most ofthe countries around the world. According to the data issued by Internet World Statsin2013, the number of global Internet users increased by566.4%from2000to2012.The private use of Internet in China started much later than other developed countries,but there is a sustained and rapid development trend in the number of netizens. Asof June,2013, the number of Internet users in China was59million, which rankedthe first in the world. In the meantime, the Internet market of China has much spaceto upgrade itself.Free competition will inevitably introduce monopoly to the market and relevantdisputes arose frequently both domestically and overseas. Being affected bynetwork effects, the competition facts in the Internet industry became unpredictable,which makes the recognition of monopoly even harder. The regulations ofmonopoly in Internet industry of China are immature and more developed policiesand methods are yet to be introduced. Recent years, even the judgments of courtsregarding monopoly in the Internet market are being judged and questioned bypeople. The regulation on the abuse of market power in the Internet industry becomes an urgent issue in the anti-trust area, especially regarding those actssuspicious of monopoly and frequently being argued about. This paper will startwith the unique characters of Internet industry, and analyze case by case theregulation on the abuse of market power in the typical business sections of theInternet industry. The main part of the paper consists of four articles:Article one introduces the history of the Internet industry in China and theemerging of relevant monopoly, and compares those with the development of Internetindustries in other countries. In the meantime, it will briefly introduce two typicalmonopoly cases in China and show the main purposes of this study.Article two analyzes the characters of the Internet industry and the challengesthey bring to the enforcement of anti-trust law, including the influence on the marketpower, bilateral market effect, network externality, innovation driven, etc. Thisarticle will analyzes true cases in the Internet market and other relevant markets andcome up with questions relating to the enforcement of anti-trust law in the Internetindustry with special characters.Article three analyzes and discusses the recognition of abuse of market power inthe Internet industry and provides the clues and paths to resolve relevant problems.This article mainly includes the division of relevant market and recognition of theacts of abuse, and discusses the limitations of the current policies and methods andfurther draws the road map for the recognition of abuse of market power in theInternet industry.Article four gives advises on the regulation of monopoly in the Internet industryin China and provides methods to resolve the problems exposed in the previousarticles, including the possibility of defining relevant market vaguely, exploring otherrules to replace SSNIP and the development direction for future legislation andenforcement of the anti-trust law.
