The Investigation Countermeasure Research Of Malfeasance Crime In Regulation Of Illegal Construction

Along with the economic and social development, all over the countryaccelerated the pace of urban development and construction, which gives a"hotbed" to the breeding and spread of illegal construction, combined with thelack of regulation of the relevant law enforcement to illegal construction iswidespread, and the problems that the owners of illegal construction collaboratewith the law enforcement personnel and let alone the illegal construction areprominent, illegal construction has become the pain of urban construction andmanagement. In order to curb effectively the momentum of illegal constructionspreading, crack down severely the behavior of amassing fortunes illegally bytaking advantage of the land requisition and house demolition in the urbandevelopment and construction, optimize the environment of development, makeregulations on city planning, create a healthy and harmonious socialenvironment actively, it is imminent to crack down severely the illegalconstructing behaviors. Procuratorial organ is the legal supervision organ of thecountry, the procuratorial authority has certain attributes of social management;it takes on an important mission and responsibility for promoting socialmanagement innovation, promoting scientific development and building aharmonious society. To procuratorial organ, the task of combating andpreventing duty crime is an important part of performing the duties in legalsupervision; it plays an important and basic role in punishing and preventingcorruption system. Therefore, it is an important topic which needs to considerfor the work of malfeasance crime in regulation of punishing and preventingillegal construction, how to give full play to the functions of combating andpreventing duty crime, and take an active part in social construction and social management innovation.In addition to the introduction, this paper is divided into three parts:In the first part, the malfeasance crime in regulation of illegal constructionis summarized, including the concept, characteristics and committing meansthese three aspects of content of the illegal construction and the malfeasancecrime in regulation of illegal construction, covering the basic situation of suchcrimes. The second part from the research on the rules of laws and regulations,summarizing the law of illegal construction, understanding the basic situationand so on these eight aspects, summarizes the strategies and methods ofinvestigation which the anti-malfeasance department of some area’sprocuratorial organ used in investing the malfeasance crime in regulation ofillegal construction by being based on the function of anti-malfeasance, and thewriter hopes that it has a certain reference value to the investigation of suchcases in the future. The third part emphatically summarizes and analyzes theoutstanding problems that exist in the judicial practice, mainly presented in thesethree aspects that the handling effect is not very ideal, dealing with cases isdifficult, and the quality of cadres needs to improve. For this, the writer putsforward five suggestions on how to do a good job in punishing and preventingthe malfeasance crime in regulation of illegal construction by combining thereality of procuratorial organ’ work, and hopes to be able to give full play to thefunctions of the procuratorial organ, attempt to promoting the development ofeconomy and society stably and healthily.
