With the rise of internet and the development of electronic commerce, overseas shoppinghas been increasingly favored and sought after by people. Compared with the traditionalcommodity trade mode, the business means and the business environment under C2C modewhich has been changed directly lead to hidden fraudulent trading. Studying on C2Cfraudulent issues in overseas shopping and building legal regulation are conducive to adapt tothe diversified commodity trading environment and fulfilling some law gaps, providing legalbasis and institutional guarantee for C2C overseas shopping.The article is divided into three parts.The first part is about fraud issues existed in C2Coverseas shopping. First of all I introduce fraud and analyze its forming reasons, then pointout the bottlenecks to investigate it from the perspective of the existing legal system, and mydiscussion will focus on the following four aspects: law application, determination ofjurisdiction,affirmation of the defendant and the definition of shopping web sites’ legal status.The second part discusses the shopping fraud prevention system of C2C overseasshopping, covering the information disclosure system established with regard to traders’identity as well as the information about commodity and service and social credit systemperfected from the perspective of credit evaluation system, supervision and punishmentmechanism of dishonesty violation and personal credit evaluation and credit report.The third part concentrates on the establishment of multiple mechanisms for theresolution of C2C overseas shopping fraud disputes.It mainly studies from the aspects ofnon-litigation settlement system, litigation methods and related references of foreignadvanced and feasible practice so as to resolve the fraudulent disputes in overseasshoppings,to standardize the order of network transactions and to protect the legal rights andinterests of traders.
