Empirical Study On Dangerous Drunk Driving

The "PRC Criminal Law Amendment (eight)”, executed on May,1,2011,added dangerous driving crime formally, and the crime shows an increasingtrend. Many procuratorates are still exploring in judicial practices, withoutcorresponding judicial interpretations to clearly stipulate the crime and thereis no uniform standard in the conviction and sentencing. All these factorsresulted in some confusion in practice. To solve such problems requirescombing legislation and judicial practice.This article firstly offers an empirical analysis on cases handled by somelocal procuratorates in Jiangsu Province during the past two years. Aimed atmeeting the requirements of judicial practice, sticking to the principle ofsuiting punishment to crime, in the perspective of practice as well as theory,this article carries out an in-depth exploration on practical problems and putsforward relevant suggestions for improvement.
