Property right is one of the most important and basic rights. Propertyrights include a range of rights including ownership, mortgage lease andhabitation rights. These rights are fundamental to peopleā€™s daily life andfinancial status. In the meantime multiple stakeholders relating to property ormultiple function of such a right may inevitably cause conflicts. In practice, itis common that some conflicts between the ownership right and the right tolease ownership right and right to habitation mortgage right and priority tosettlement of project cost may occur, It is necessary to develop a completeand rigorous legal system to deal with such complex issues. However, thecurrent laws have many gaps which affect peopleā€™s confidence in coping withsuch problems. Hence, it is important to investigate relevant legal principlesand laws in order to build up efficient legal framework protecting propertyrights and the property market. The author in his many years of judicial trial,deeply housing lease contract disputes, real estate lease ownership and crossownership and the right of common single construction contract disputes and commercial housing sales contracts with the infiltration of each other realestate disputes rights subject interest conflict involves complex, the law is notvery clear specific brought greater confusion to the judicial trial. In this paper,the author attempts through to the concrete case analysis, put forward thecorresponding legislative suggestion, reconstruct the relevant legal provisions,in order to improve the law, to facilitate the fair and reasonable judicial.
