The Research Of Environmental Criminal Ligislation

With the deepening of reform and opening up as well as the rapid development of China’s economy, the increasingly serious environmental problems have been rather noticeable. To a large extent, it has been a significant social problem of our society. The environmental criminal legislation in China only started in recent years, and it is far from perfect in many aspects, such as the legislation value of environmental crimes, the specific provisions of environmental criminal legislation, the environmental criminal liability, etc. And the legislation does not play a proper role in curbing and punishing environmental crimes and protecting the environment resources. In view of the existing defects of the environmental criminal legislation in our country, the status quo of environmental crimes and the status change occurred in future, this paper proposes related suggestions to better prevent and punish environmental crimes, solve the problems of environmental pollution and resource destruction, and the natural resources and ecological environment. In this paper, by analyzing the specific problems and defects of the criminal environmental legislation in China, comparing the legislative achievements of other counties, I put forward several environmental criminal legislative suggestions by reference to the relevant legislative experience of the developed counties, so as to perfect our country’s environmental criminal legislation, and make criminal law better play its role in environmental protection.
