The Exploration Of Vehicle Devaluation Damages In The Traffic Accident

In this paper, by combing the differences of legal theory and judicialpractice, analysing the basic nature and the applicable rules of thevehicle devaluation damages, combined with kinds of problems in practice,and then put forward recommendations of building the compensation system.Text consists of four parts, the first part, cites the typical cases ofjustice and research statistics, then combines with theoreticalperspectives, as the issues raised. The second part, analyzes thedisagreement is due to five reasons including legal basis, value choice,the main responsibility, compensation scale and valuation identification,and thus demonstrates the compensation belong direct loss and itscompensation rules,so provide direction to solve the problem. The thirdpart linkes with abroad experience and relational damages, as well ashouses, artwork, and rational component of tax laws and economic law.The fourth part, from five aspects including the scope of compensation,compensation standards and principles, legal basis，shared responsibilityand valuation identification，puts forward opinions and suggestions forconstructing the compensation system of Vehicle Devaluation Loss.
