Enterprise legal risk identification is the foundation of the enterprise risk management system. This paper summarized the methodologies adopted in China and overseas for enterprise legal risk identification and aimed to explore a new way to further improve the effectiveness and efficiency of enterprise legal risk identification. The research started from the investigation on enterprise legal risks and the enterprise legal risk management system and performed the comparative analysis covering:a) The Guidelines for Comprehensive Risk Management of Central Enterprises issued by SASAC ("State-owned Assets Supervision and Administration Commission"); b) Guidelines on Enterprise Legal Risk Management co-issued by AQSIQ ("State Administration for Quality Supervision and Inspection and Quarantine") and SAC ("Standardization Administration of China"); c) ISO31000:2009issued by the International Organization for Standardization; d) Enterprise Risk Management-Integrated Framework issued by COSO. Afterwards, the author is looking for a breakthrough in the methodologies of enterprise legal risk management from the perspective of the combination between HACCP ("Hazard analysis and critical control points") and Event Inventories methodologies which are based on information management. The author performed comparative analyses between risk management and legal risk management; and between Chinese and overseas latest theories and practices. Based on the comparative analyses, it can be concluded that current methodologies commonly adopted in China could be further improved in compatibility, instantaneity and effectiveness-these three areas also constituted the most important and difficult part of legal risk identification.Based on "communication and negotiation" rules in the legal risk management frame, and with references to professional knowledge in relation to the combination between HACCP and Event Inventories, this paper achieved a breakthrough in developing new methodologies for legal risk identification in relation to legal contracts. The new methodologies can reduce the costs of legal risk identification; improve the practicability and effectiveness of legal risk identification; and provide compatible risk information to other risk management modules in the Comprehensive Risk Management framework.
