On The Statutory Marital Property System Of China

In this paper, we study legal marital property system in our country to explore whether the property system of income made together after marriage accords with national conditions of China at present. In the first part of the article, we introduce statutory marital property system in our country, including the theory of the marital property system, the concepts and types of the marital property system leading to compare all kinds of marital property system and the basic theory of marital property system in our country as well as the principles of legislation as basis of analyzing the superiority of the type of statutory marital property system. In the second part of the article, by comparing the property system of income made together after marriage and other kinds of marital property system, we put forward the property system of income made together after marriage has its superiority and it should be taken in China nowadays and a period in the future. In the third part of the article, we describe the design of legal marital property system in China, pointing out some existing problems and deficiencies. In the fourth part of the article, we put forward the perfect proposal on the basis of the third part.
