Research On The Issues Of The Concurrence Of Real Estate Execution

The Real estate execution competition problem occurs frequently during civil enforcement process. While, the regulation of current Civil Procedure Law and the related laws on the real estate execution competition is not complete at all, which impedes the solving of real estate execution competition problem and also it is not better for the safeguard of the legitimate rights. Based on the related research theories, this paper focus on the elaboration of real estate execution competition and also propose the author’s own opinion.This paper is divided into five parts:The first part starts from a case, then the author points out the research topic, which is real estate execution competition.The second part is an introduction to the real estate execution competition, which includes the definition of real estate execution competition, composition and forms.The third part mainly discusses the legal basis of solving real estate execution competition problem home and abroad, and also the main ideas of solving different real estate execution competition problems. The author also points out his own opinion at last.The forth part mainly lists the main problems occurring during in our country which includes the legislation is too simple, not accurate and comprehensive enough. The related regulation has a lower executive level and the regulation of prohibition repeat preservation conflicts with priority doctrine etc.In the fifth part, the author gives his advises on improvement of real estate execution competition problem.
