Aprroval System Research On Permenant Residence Of Foreigners In China

Permanent residence system is a law system by which a country gives permanent residency to foreigners who meet the qualifications.On August15,2004, the Ministry of Public Security and the Ministry of Foreign Affairs jointly issued Approval Provisions of Foreigners’ Permanent Residence in China, which is a milestone that China established the Foreigners’ Permanent Residence system. It clearly established qualifications, application material, approval process, limits of approval and examination, and legal validity of permanent residence permit. Foreigners’ Permanent Residence system has been in existence for a decade, and it has been playing an important role in attracting foreign investment and facilitating family reunion, and laid the foundation for the system’s further perfection.In recent years, China has an ever tighter relationship with international economy, more frequent exchanges of personnel and more fierce competition among international talents. As a result, disadvantages in the permanent residence system is increasingly prominent and fails to meet the needs of development of Chinese economy and society, such as high standard of qualification, limited range of application, and only one measure of approval.In this paper, the writer first analyses the present permanent residence approval system in China, with studying the Exit and Entry Administration Law of the People’s Republic of China and the Exit and Entry Administration Regulations of the People’s Republic of China, on the basis of our nation’s and the people’s interest, taking China’s economic and social development into consideration. Then, the writer tries to solve the systematic problems in examining and approving the foreigners’ permanent residence by taking example of the emigrant systems in USA, Canada and Singapore and suggests applying to quota approval, residence guarantee and social integration system. The purpose is to keep China’s exit and entry administration order, make good public security order concerning foreign affairs, and help further expand the opening-up and economic development.
