Since Shanghai Free Trade Zone listed, its orientation of financialinnovation has basically been established. In order to promote Shanghaito become a global pricing, trading, innovation, and clearing center, thedevelopment of offshore financial markets have become major direction ofthe financial innovations in the Free Trade Zone. But we can not be ignored,while offshore finance rapidly promoting economic development there arealso high-risks. To ensure the healthy development of offshore finance,a sound legal and regulatory system is a necessary prerequisite andguarantee. The clear direction of Shanghai Free Trade Zone offshorefinancial market is ensured, a reasonable legal supervision has beenbecome the focus of discussion. But the content of the current legal andregulatory regime about offshore finance is conservative, other parts ofthe regulatory rules involved is not comprehensive. From this point,offshore financial regulation requires updating and refining the content,as well as, it is the significance of the topic about this article.This paper firstly starts from our market conditions of the offshorefinance, the deficiencies of the existing legal and regulatory system, then gradually analyzes the necessity to develop offshore financialregulatory rules in Free Trade Zone. Secondly, we shall face the relatedissues of offshore financial markets regulatory which need to be addressed,such as, offshore financial supervision mode selection, the offshoremarket access rules, offshore business regulation, taxation supervision,exit mechanism, in order to better solve these problems, we can learn fromother countries regulation and supervision experience of the offshorefinancial market rules, combined with Shanghai Free Trade Zone specificcircumstances. We need to conduct in-depth study from choosing theoffshore financial market model to building the financial laws andregulatory rules. Hoping the recommendations can become feasiblesuggestions to further improve the offshore financial legal regulation.
