The Infringement Analysis Of Photography Works Copyright

As technology continues to develop, in recent years the excellent photography works continue to emerge, the protection problem at the same time about photography copyright has become the problem that people cares, but also the emergence of a large number of cases of infringement on copyright of photographic works. Because of the particularity of photography, also appeared in the diversity of photographic works infringement, is not only the conventional remake, copying the infringement behavior, and to tort by means of advanced technology through deformation approach, and due to the characteristics of photographic works often set a variety of rights in a body, is very easy to produce conflict between the all right. In this paper, starting from the classical cases, in the basis of theory research, photography works copyright protection related legal resources, through the detailed analysis of the general problems of current photography works copyright protection and special problems, tries to provide effective legislative proposals for our country to establish the perfect photography works copyright law protection system.This paper is divided into four chapters, on the basis of copyright law on the basic principle, focuses on photography as a kind of special topic features and particularity of the copyright law protection. The specific contents are as follows:The first chapter is about the definition of basic concepts and typical cases introduction, this is the starting point and foundation of this thesis research. Mainly explains the concept and characteristic of photographic works, and through the analysis of typical cases leads to the key point of this article is to discuss the problemThe second chapter is to protect the copyright of photographic works. First of all, to conduct a comprehensive analysis, the elaboration in view of problems of photography works copyright ownership, this part will focus on the multiple works of photography relates to the right person and various types of photography copyright ownership of the study; secondly, to analysis and research of photography works copyright infringement and compensation issues.The third chapter is about how to protect the special photography works copyright. This chapter is divided into two parts, first discusses the protection problem of portrait photography works copyright, focuses on the analysis of the question of the right conflict and portrait rights; secondly, to carry out research and analysis of issues related to copying photography.The fourth chapter is to build and improve our photography works copyright protection system suggestion. Based on analyzing the present situation of main protection of copyright photography in our country and the insufficiency, proposes some suggestions to perfect photography works copyright protection, including the technical measures to improve the legislation and the system of collective management of copyright strengthening.
