Study On Empirical Investigation Of Community Correction In Pingtan Comprehensive Pilot Zone Of Fujian Province

The implementation of community correction system embodies the global development trend of China’s penal system and measures to mitigation. From the establishment of research group by Ministry of Justice in2002to the pilot implementation of six provinces (municipalities) in2003, and then to full implementation of all over the country in2009, community correction showed powerful vitality. Through the continuous research, the whole country accumulated a lot of worthy experience and achieved good social effect and political effect. But due to the influence of social and economic development level, social universal legal concept as well as traditional ideas and other factors, both in the criminal theory or in judicial practice, the whole country still need to explore more suitable pattern of community correction to satisfy the requirements of localization. Therefore, based on the work practice of community correction in Pingtan Comprehensive Pilot Zone of Fujian Province (hereinafter referred to as "Pingtan"), this thesis aims to launch a full investigation among all concerned including the management of community correction, inmates and ordinary residents and tries to explore more effective work pattern of community correction from the grass-roots governance.This thesis consists of introduction, text and conclusion, and there are four parts in main body.Part Ⅰ:Clarification of the concept of community correction and its theoretical basis and realistic significance. Firstly, this thesis differentiates and analyzes related concepts of community correction, and then expounds related theoretical basis of the implementation of community correction, and finally explains the significance of the implementation of community correction.Part Ⅱ:The diagnosis of implementation status of community correction in Pingtan. This part takes Pingtan of Fujian Province as a case, briefly expounds the background of the investigation in Pingtan, selects inmates and ordinary residents for questionnaires and head of community correction institutions at all levels and grassroots community correction workers for on-the-spot interviews, and obtains front-line work implementation status of community correction as the basis of viewpoints of this thesis.Part Ⅲ:The existed problems in work of community correction in Pingtan and its reason analysis. Based on a comprehensive understanding of present implementation status in Pingtan and its analysis from Part II, this thesis deeply analyzes the existing problems in work of community correction in Pingtan.Part Ⅳ:Based on the diagnosis of implementation status in Part II and the problems raised in Part III, this part introduces countermeasures to improve community correction in Pingtan, in order to provide helpful enlightenment and reference for community correction work in other areas.
