Study Of The Civil Protection Order System

The Civil Protection Order System is judicature relief measures which for protectthe victims’ personal rights and proprietary rights who are subjected to the domesticviolence from the bully project mentally and animally. This institution has been animportant tool to prevent the domestic violence in many countries and regions byoffering victims protection and remedy that are more effective and efficient. In theProcessing Guide to Matrimonial Case Involving Domestic Violence drafted by theSupreme People’s Court Institute of Applied Jurisprudence in2008, our countryintroduced the Civil Protection Order System, namely the Personal Safety ProtectionRuling for the first time, and since when various regions issued a series ofcorresponding local regulations in succession. In its five years’ operation, the PersonalSafety Protection Ruling System with Chinese characteristics brings notable results,but in the mean time exposes many problems. I propose to compare the PersonalSafety Protection Ruling System in the Mainland with the Civil Protection OrderSystem in Taiwan, so that I can analyze the differences in a comparison way andpropose some corresponding suggestion.This thesis is divided into four parts.The first part: An overview of the Civil Protection Order System. This partmainly introduces its basic concepts, characters and functional value.The second part: About the Personal Safety Protection Ruling System in theMainland China. This part mainly summarizes the provisions on the Personal SafetyProtection Ruling System in current China. The next part of comparative studydevelops on this basis.The third part: Comparison on two different protection order systems in theMainland and in Taiwan. This part first briefly introduces the Civil Protection OrderSystem in Taiwan, and then its focal point is selected to compare with the PersonalSafety Protection Ruling System in the Mainland, so that their differences areanalyzed. The fourth part: Suggestion to perfect the Personal Safety Protection RulingSystem in the Mainland. This part goes from two perspectives, the entity content andthe process content. Based on the difference comparison result of the third part,corresponding suggestion is proposed in the form of law recommendations.
