Especially the criminal accused person’s right of citizens’ basic rights can be effectivelysafeguard is whether a country litigation, democratic and civilized standards. For a long time,our country in the aspect of rights of criminal accused person many deficiencies, in general,main show is the constitution for the accused person right content regulation is notcomprehensive, single protection form, did not play its due role, as the criminal procedure lawto protect people being prosecuted. In addition, in judicial practice, serious disconnectbetween the constitution and judicial activities, is not conducive to protect the rights ofcriminal accused person. Therefore, criminal accused person’s rights and should be closelylinked to the basic rights of citizens, and the important right of criminal accused personestablished in the constitution, and design a corresponding effective relief mechanism, workalong both lines, so as to make the right of criminal accused person truly guaranteed.Argument is presented in this paper，is the current situation on the basis of the criminaljustice and the constitution, through the analysis of the causes of defects, the use ofconstitution and criminal procedure law of the existing research results, put forward theestablishment and perfection of our country criminal accused person’s constitutional rightssafeguard mechanism. This paper is divided into four parts:The first part: the definition of criminal accused person constitutional rights. The conceptof criminal accused person and other criminal prosecution of people who definition of theconcept of the constitutional rights, and on the criminal accused person carries on thesummary and summarized the characteristics and nature of constitutional rights.The second part: on the constitutional rights of criminal accused people in foreigncountries. Studies the protect of criminal accused person in foreign countries such as Britainand American，studies the present situation and problems of the constitutional rights,comparative analysis, summed up the widely accepted can rise to constitutional rights of therights of the accused person.The third part: the constitutional rights of criminal accused people to protect the statusquo. About the present situation of criminal accused person constitutional rights protection inChina is analyzed, some defects in a summary, and find the deep reasons of the lack of it.The fourth part: to perfect our criminal accused person protection countermeasures of constitutional rights. From two aspects of the constitution and criminal procedure law,strengthen the protection of the rights on the accused person, both, truly protect the guaranteeof constitutional rights stipulated in our country by law.
