With the development of the society ran by the law, the civil procedure is theimportant method for the social economic exchange, but we are facing with abuse whenthe enjoyment and exercise of sue right and litigious rights. As Judicial reform notfinished, the amount of cases exploding and the lack of lawsuit resources, the hazard ofabuse is so obvious which increases the costs of the proceedings and the waste of theprecious lawsuit resources. The article probes the problem how to define the abuse oflitigious rights firstly, and then study the definitions and researches of the abuse abroad.According to the cases in my legal career, the article will enumerate the types of the abuseof litigious rights.At last, the writer raises the solutions to the abuse.
