| A famous trademark dispute happened between JDB Group and guangyao L.L.C.in2001causes huge debate. This paper consists of three parts, introduction, body and conclusion&epilogue.In the part of introduction, it tells the theme of this paper and the reason why the author wants to make a deep study on it.The body is the most important part of this paper and is divided into four small parts. The first small part briefly introduces the basic details of "Wang Laoji" trademark dispute and points out that the same kind of problem happens everywhere but only in this case it catches people’s attention. So it is very important to check out why things happen like that.The second small part tells the three main ideas hold by different people. The first is that after the termination of the "wang laoji" trademark license contract, the guangyao have the right to possess all the value that created during the period of trademark license. The second idea is that JDB have the right to possess all the value that created during the period of trademark license. The last idea is that both the guangyao and JDB have the right to share the value that created during the period of trademark license.The third small part chooses five deeply related issue and try to make a deep study on them so that the author can know how to distribute the value which created during the period of trademark license exactly. According to the analyses above, the anther believes that both the guangyao and JDB have the right share the value that created during the period of trademark license.The fourth small part talks about the significant characteristics of four different kinds of regulations, and choose the most suitable one as the best regulations to govern the same issues happens in the future. Finally, give the legislative suggestion:make a new rule to the trademark law.In the epilogue, the author summarizes the achievement he got in this paper and the problems in paper which should be solved in the future. |
