Study On Food Supervision Dereliction Crime

The crime of dereliction of duty for food is one of the accusations in the eighth reviseof the criminal law. To punish this crime is to safeguard the order of the food supervisonand to safeguard the peoples life and properties. There are several disputes about this crime,such as the factors of it and the application of the law, these disputes will be discussed inthis paper.There are four parts in this paper.In part one,it first introduce the background and how set the accusation,then itdescribe the necessity and the correctness of setting this accusation.In part two, it analyses the subjective and objective factors of this accusation, itincludes the subject, behavior, result and the state of mind of this crime. All these establishthe foundation of this paper.In part three, it analyses some difficult problems in the implement of the law about theaccusation, then it put forward the relative certain and reasonable viewpoints.Finally,to solve the defects in the theory and practice,it tables some advices forimproving the law in order to be benefit to the legislation and judiciary.
