In accordance with the existing Criminal Law, the description anddefinition of affray are of the nature of simple counts, which provides onlythe name and the constituting elements of the crime. Most ofthe affray sections are of purely descriptive nature. Furthermore, they havebeen enacted leveraging superabundant definitions and theoreticalapplications; different types of the practical prosecution standards haveconstituted a complicated legal environment, which in effect interferes andimpedes the daily case handling process. Author incorporated the knowledgeand experience of the cases that have ever been confronted during his judicialpractice, and analyzed the constitution of the crime from four aspects. In thispaper, the crime of affray has been regarded as a complicated object–from asubjective view, it does not require both parties to be equipped with deliberateintention of fight and the offender does not have to have the motivation ofrogue or hooliganism; from an objective view, affray may be appropriatelydivide into two acts of perpetrating, i.e. gathering and fighting or violence,and it may not be necessary to have a ringleader for the subject of the crime.Furthermore, the author asserts that section292of the Criminal Law is aprovision of attention–it defines affray as a transformed offense rather than an imaginative joiner of offense, and provides a sophisticated analysis todemonstrate types of special circumstances of the crime and the methodologyof identifying the subjects of the transformed offense. Finally, by elaboratingsome authoritative affray cases, the author concludes that self-defence isavailable under certain circumstances, and in addition provides an analysisabout identifying self-defence to support the practical cognizance for thecrime of affray.
