In the development of human history, medicine as necessary a science of socialdevelopment has always been the various periods and national attention. It can be saidthat the development of human history is the history of the development of medicine,because man can never avoid the question of sickness. The development history ofmedicine there was always the contradiction between doctors and patients, how tobalance the interests of both doctors and patients has been the concern of the law.While in the oil cross collision medicine and law reflects the complexity of medicineand ethics, law how to adjust the various problems in medicine appears especiallyfocus on medical damage liability is the concern of this paper.Along with our country people’s material life level unceasing enhancement, thepeople for their own health concerns are increasingly high, at the same time to themedical institutions are more and more "picky". Medicine is a science of human bodyis very complex and changeable characteristics of medical institutions, andunderstanding of the disease itself and the methods of diagnosis and treatment has therelative lag and unknown characteristics,the patient will first think is the doctor’sdereliction of duty, but the doctor has not God, what disease can cure. In the processof medical injury caused by the fact that the patient may have all kinds of subjectiveand objective reasons. This has cause dour country at the present stage of the doctor-patient relationship with mutual trust, the characteristics of media and publicopinion are like attention and easy to cause the collective events.
