Consideration On The Subjects Of Social Investigation For Juvenile Delinquency

In recent years, the proportion of juvenile crime continues to rise, and graduallyshowing a younger age, violence, adult and other trends. And in the process of dealingwith the juvenile criminal cases, still have to pay attention to the special nature of itssubject, be treated differently from adult criminal cases. Causes of juveniledelinquency from the minors themselves, family, social and other aspects, the primarysolution to control and reduce juvenile delinquency way not to punish crime, butshould that reform and crime prevention. Therefore, the minor nature of the offense ofcriminal cases against various criminal acts and to take a different criminal justicepolicy, but focus on the implementation of the light punishment in the proceeding, andthe non-imprisonment measures is still a measure of justice and progress, theestablishment of social investigation system but an effective way to solve suchproblems. However, on the basis of existing legislation, in terms of the entity or theprogram do not have specific provisions on the implementation of the socialinvestigation system, only some principled guidelines, which are still in practicepatterns across from each other and the initial exploration stage, not yet can form aunified system of comprehensive social investigation, and thus proposed socialinvestigation report or the conclusion of the final judicial trial or sentencing at thebreak should be able to play the role is not obvious, so I wanted to learn from the social crime investigation system of foreign minors compared with our experience andpractice over the juvenile delinquency social investigation practice mode, focusing onthe subjects of social investigation to build perfection advice.This paper introduces the system ideal for building social investigation, focus isdivided into three longitudinal section, an overview about the subjects of socialinvestigation, the practical problems about the subjects of social investigation onjuvenile crime, and the final ink put forward suggestions and ideas to improve thesubjects of social investigation minor crime. Each transverse section is divided intothe concept of juvenile delinquency social investigation system；the existing legalbasis and problems of our discussion about the subjects of social investigation minorcrime; The domestic and foreign minors crime subjects of social investigationcomparison, this section including the status of our country and foreign countriesabout the local characteristics of juvenile crime subjects of social investigation; Theproblems of our country about the subjects of social investigation in judicial practice.For the last part, I want to discuss the status in litigation about the subjects of socialinvestigation, and put forward suggestions and ideas to improve the subjects of socialinvestigation minor crime from self-humble opinions.I hope this paper would place a greater prospect on juvenile delinquencyassistance and education work. To enhance the minors’ legal awareness and correcttheir errors and make a fresh start successfully integration into society.
