With the rapid development of Chinese urbanization, more and more rural land has been expropriated. Land has a very important position in the majority of the life, so land requisitioned involveds the vital interests of farmers. Under the imperfect social security system background, improper land requisition, the peasants losing the land means losing work, resulting in the intensification of contradictions.Therefore, the main problem is to safeguard the interests of farmers in the land expropriated.The rural land expropriation involving numerous relations, such as the relationship between government and farmers, between the centre government and local government and so on. To handle these relationships and ensure the land requisition is carried out smoothly, the most important is the local government as the leader of the land expropriation must exercise their functions and powers legally.Today, some local government has a bug about land expropriation, result in many anomie behavior, for example, excessive exercise land expropriation rights resulting in the abuse of levy, and government officials abusing power for personal gain and rent-seeking corruption, etc. The reason is the government officials pursuiting of profit maximization, and the government is inaccurate to one’s own function positioning. At the same time, lack of the idea of building a service-oriented government and the rule of law, add deficits of institutional safeguard.To guarantee the local government behavior conforming to the rules and laws, except government officials changes in the concept of themselvies, the most important way is to perfect the land system, officials examine mechanism and China’s current fiscal system. Only the government behavior conforming to the rules and laws, the land market will establish orderly, the interests of farmers to get real maintenance.This thesis begins with an elaboration of basic theories of government behavior, summarizing the anomie behaviour during rural land expropriation of our country local government. Based on the public choice theory and the principal-agent theory to analyze the causes and then to puts forward the measures and countermeasures of government, in order to standardize and improve the government behavior, to safeguard farmers’land property rights in China.consequently we can really protect peasants’ rights of land and mostly improve the system.
