Criterion Research Of Intellectual Property Rights’ Abuse Between Multinational

In the context of economic globalization, intellectual property is becoming increasingly important; the subsequent abuse of intellectual property rights is increasingly present. The abuse of intellectual property issues facing increasingly prominent since China joined the WTO, Scholars aroused great attention. A lot of disadvantages appeared with the rapid development of China’s intellectual property rights. Domestic and international researches is developing, I summed up the status on the research premise, based on China’s national conditions and made a theoretical analysis and conclusions, mainly to discuss the abuse of anti-monopoly law as the core intellectual property rights in all aspects of legal regulation.In this paper, comparative analysis, normative analysis, and empirical analysis method against the abuse of legal regulation of intellectual property rights were systematically in-depth studied. In this structure, the addition to the introduction conclusion, there are the other main four parts.The first part tells about the basic theory of regulation described against the abuse of intellectual property right.The second part tells about the Regulation realities of the abuse of intellectual property rights of transnational corporations in China.The third part, researches the European Union, the United States and Japan-related system, and concluded on this basis for our reference model.The fourth part, made the legal regulation proposals against abuse of intellectual property rights of transnational corporations, including the perfect "anti-monopoly law," law in the relevant departments to develop specific norms related provisions; establish a sound, such as the relative junk infringement notice letter abuse of anti-lost, etc.
