Personal Guardianship System Of Adult Mental Disorders

Adult mental disorders personal guardianship system is a safeguard in the special circumstances of the legitimate rights and interests of the adult civil law system,and it is an important part of the adult guardianship system. Since the20th century, under the influence of the new concept of international human rights, many countries build a more applicable and flexible system. Our adult guardianship legislation is found only in the General Principles of the Civil Law of the People’s Republic of China.It is not conducive to the application of the law. However, in real life, ill-treatment of mental disorders, even normal people are forced to confirm that they are mental disorders. Therefore, we must improve our adult mental disorders’guardianship system, in order to protect the legitimate rights and interests of people with mental disorders, to promote family harmony, and to maintain the social transaction security and social stability with practical guidance.Based on the new concept of international human rights, investigation and analysis of the current situation home and abroad, using comparative analysis, literature research, sociological research method, semantic analysis and other research methods, we discuss the defect of our adult mental disorders’guardianship system and give some suggestions.This article is divided into three parts:The first part is the basic introduction of adult mental disorders’guardianship system. Including analysis of the concept and content of adult mental disorders’guardianship system, the status of guardianship of adult mental disorders as well as the current legislation and related systems and academic point of view; The second part is to explore the adult mental disorders’guardianship system, from four aspects of the subject, rights, obligations, responsibilities to elaborate; The third part is the improvement of mental disorders in China guardianship system, this part will give some suggestions to improve our adult mental disorders’ guardianship system.
