Japanese Political Right Deviation And Unlocking Of Collective Self-defense Right On International Order From The Perspective Of Military Law

The conservative trend and political right deviation of Japanese party have along history and they have an immense impact on the international security situationafter war. Since the twenty-first century, especially in recent years, the political rightdeviation in Japan becomes extremely obvious and they are trying to distort the factof invasion during the Second World War, deny the crimes during the war and dodgethe state responsibility stated in the International Law under the post-war system. Inrecent years, the Japanese government constantly causes the international publicopinion disputes through a variety of measures; for example, the governmentofficials make formal visits to Yasukuni Shrine repeatedly, modify textbooks,instigate disputes through the controversial island, revise interpretation ofconstitution and participate in arms race. These events are not accidental and theyhave internal deep-seated relation, which shows the inevitability under the tendencyof Japanese political right deviation. Firstly, if Japanese wants to bring thecontroversial island into its territory, they must deny the invasion during the SecondWorld War and avoid the responsibility. Secondly, Japanese should slip the leash ofpeace constitution and break through the restrictions on peaceful use of force in theinternational treaty in order to carry out arms race legitimately and develop itsmilitary force. This is because Japanese wants to seek the identity of “Normal State”and it is also the impetus for Japanese political right deviation. Of course, the originof Japanese political right deviation is that the political parties in Japan are inclinedto conservative trend and the right deviation reflects nationalistic tendency. In theJapanese political circle, the consensus is reached between the prevailing democracyand the conservatism advocated by politicians in Japanese Conservatives and theystrive for the identity of “Normal State” together so that the favorable conditions areprovided for the political right deviation. The American strategy for returning toAsian-Pacific region also promotes the development of Japanese political rightdeviation. The international community, especially the countries in Northeast Asia shouldpay high attention to the Japanese political right deviation and such politicaldevelopment tendency is not beneficial to the world peace and stability and mayseverely threaten the security in Asia. If such political tendency continues to spread,the unpredictable losses will be brought to the surrounding countries, especiallyChina. In2014, the Japanese government convened the interim cabinet council andrevised the interpretation of constitution so that the Japanese “exclusivelydefense-oriented” policy reversed. Although the Japanese government only strives toregain the identity of “Normal State” through constitution interpretation, its arbitrarymodification on constitution interpretation is an undisguised challenge to theinternational security order after the war and it is also the contempt on theinternational convention, which means that the Japanese political right deviation hasentered into a new stage.It is well-known that as the axis power during the Second World War, Japanwaged the wars of aggression against China in the last century and was defeated andsigned a series of international treaties which formed the common wish of theinternational community; therefore, Japan must execute the provisions in the treaties.However, the Japanese government violates the international treaties openly, revisesthe interpretation of constitution arbitrarily and unlocks the right of collectiveself-defense, which is forbidden by international community. The purpose forrestricting the Japanese collective self-defense right is to prevent the comeback ofJapanese militarism which may bring severe disasters to people all over the world.The purpose for the Japanese to revise the constitution arbitrarily is to get rid of thepostwar aggression responsibility, which must be strongly condemned by theinternational community so as to supervise and urge the Japanese to shoulder thestate responsibility. It is hoped that the international community including Chinashould attach great importance to it and be on the alert and they should take themeasures to render the necessary international constraints on the Japanese rightwing’s scheme for revising the constitution.Based on academic researches, the venation of Japanese government’sbehaviors during the right deviation process in recent years, especially after the war are reorganized from the concept and origin of Japanese political right deviation soas to investigate the Japanese government’s arbitrary modification on interpretationof constitution in the tendency of political party’s conservatism and political rightdeviation and the severe impact of arbitrary modification behavior on United NationsCharter, the international treaty, the international custom and the imperative Law.
