The fourth plenary session of the eighteenth central committee of the CPCclearly put forward:advancing litigation system reforms of the trial central principle.It show clearly direction to improve litigation system and guarantee Judicial Justice.Meanwhile it puts forward the requirement of deeply research and discussion trialcentral principle,the fundamental problem, to litigationin the theoretic circle of actionand professional circles of our country. It inevitable includes: exact understandingand mastering of the spirit essence of the trial central principle, recognize the existingproblems and cause for practice at present, definite major tasks about reform,determine proper policy and strategy, to seek effective way of reform,an so on. Atpresent,the theoretic circle of our country lift displacement a new upsurge onstudying the trial central principle once more. Such as, the Professor ChenGuangzhong’s and the Professor Fan Congyi’s and others theoretical paperscontinuous had published in the People’s Court Daily. But,overall,both beginning ofstudy and new examination today, comparatively speaking, our country to searchthe trial central principle still has limitations. Therefore, in this paper the author tawand analysis the viewpoints of all parts and related concepts; preliminary attempt putforward own viewpoint about basic theory of Principle of Trial centered; on the basisof compared investigation extraterritorial and China present situation of Principle ofTrial centered, search problem origin, put forward some superficial opinions andsuggestions to Principle of Trial centered construction way from the great deal aspects.In order to it is helpful for future legislation and judicial.
