Research On Several Legal Issues Of The Civil Public Interest Litigation

Abstract:In recent years, with the in-depth development of China’s comprehensive national strength and social economy, profound changes have taken place in the social structure in China, the relationship between people appear to compete, flow, the trend of differentiation. The various interests intertwining, the scope of public interest expanding, environmental pollution and some other vicious incidents of violating public interests have become more and more frequent. In foreign countries, the civil public interest litigation which is a legal system has developed and formed a mature system, by contrast, China does not have a quite perfect judicial relief system. This paper takes the provisions of article No.55in the new law as the starting point for interpretation, through probing into the specific law analysis and related theory and combining with the actual situation in China to analyze the system of the present stage in China’s development status and highlights the problems in judicial practice. In addition, combined with the recent promulgation of the two involved in the civil public interest litigation judicial interpretation, in view of the existing problems and puts forward some feasible suggestions for the whole system and the framework for the improvement and future prospect. I hope these simple oversight recommendations can promote the improvement of the civil public interest litigation system in our country to a certain extent.
