Abstract:The civil procedure law amendment increased the act preservation system, which improve the system structure of our country. However, in terms of applicability, the regulation of civilian law is too principle, and the rationality of the aspect in the system, some rules did not achieve the purpose of the system design. Civil litigation judicial explanation detailed the applicable rules of the system, but rationality problems still exist. This article will be sorting out the system on the basis of basic theory, analysis of the system in our country law is not reasonable, in order to accurately apply the system in the judicial practice to provide some help.
