With the growing awareness of environmental protection, our country in the fieldof environmental protection legislation has continuously made new achievements, haslaid a legal foundation for the development of our country’s preliminary land pollutionprevention and control work. However, with the continuous progress of urbanization,the double stack of agricultural development mode is not reasonable and one-sidedpursuit of economic interests of the concept of cultivated land, causing increasinglyserious pollution problem. Although we have such as "environmental protection law","agricultural law" and other legal norms, but because of the legal norms to prevent theland from pollution of the special lack in our country, process resulted in our pollutedfarmland in repair and governance, face all sorts of problems. The increasingly seriouspollution of cultivated land realistic, forced us to reflect on their own behavior,prompted us to continuously improve the development of farmland pollution preventionlegislation system. Mainly from the guiding principles, system design, responsibilitiesclear, mechanism of public participation and the formation of the co governance abilityformation and other aspects to construct our country’s legislation of cultivated landpollution prevention and control, in order to promote the work of pollution control inchina.This paper briefly introduced in the introduction to this article research background,research significance, research at home and abroad and the research content and method,after the writing has laid a theoretical foundation; the author outlined in the second partof this paper the basic conditions for cultivated land pollution, the concept,characteristics, harm and causes including farmland pollution. The concept of cultivatedland pollution, mainly from cultivated land pollution causes, expounds the harm andinclude such as the specific content for cultivated land pollution concept, conceptsystem preliminary formation of cultivated land pollution; the author also analyzes thefeatures of different cultivated land pollution; hazards for cultivated land pollution and suggests the necessity of cultivated land pollution and the causes for repair; cultivatedland pollution were deeper discussion, in order to guide the practice better pollutioncontrol. The third part of this paper briefly introduces the overview of cultivated landpollution prevention legislation in China and the analysis of the. Separately from thehistorical development, cultivated land pollution prevention legislation of our country’sexisting legislation is analyzed, on the basis of summing up the cultivated land pollutionin China’s legislative system results, and finds out the deficiency; the fourth part of thispaper is to summarize the experience of foreign advanced legislation of the country. InJapan, Germany, America represented a brief analysis, and find out the usefulexperience of improving land contributes to pollution prevention legislation in China;the last part of farmland pollution prevention legislation perfect suggestion. Mainlyfrom the guiding principles, system design, responsibility of public participation are putforward solutions. Guiding principle claims from advanced foreign legislation principles,guiding the work of pollution prevention and control in China with a new scientific idea;the design of the system, and constantly improve the management system, pollutionprevention and control of cultivated land of our country clear responsibility, ensure theefficient operation of the organization work; responsibility, a clear responsibility form,responsibility and so on, in addition, extensive participation plus standard system ofcontinuous improvement and the public, make a contribution to pollution control.
