The United Nations Intergovernmental Panel on Climate Change (IPCC) FifthAssessment Report noted that nearly100years, the Earth’s average surface temperatureincreased by0.89degrees. The research shows that the carbon dioxide produced byhuman activities, such as methane is the main cause of global temperature increase ofgreenhouse gases, carbon dioxide, among which the most significant role. The maincause of global warming is human in nearly a century, the extensive use of fossil fuels,so that atmospheric concentrations of greenhouse gases annually accumulated rapidlyincreasing greenhouse effect. This trend, if not reversed, the21st century averagetemperatures could rise by4degrees Celsius,60cm sea level rise, which wouldecosystems, food and fresh water supply as well as far-reaching implications for humanhabitation. In this context, it is trying to change the mode of economic development toreverse this situation continues to develop, with low emissions, low consumption, lowpollution, characterized by economic development, low-carbon economy willhomeopathy birth. However, how to develop a low-carbon economy, has become thefocus of the world’s governments, international organizations and discussion of research.Among these, the more striking is that the international financial institutions, banks andother financial systems have been involved in the field of low-carbon economy, makethe low-carbon economy is most closely carbon finance markets have arisen. Theselow-carbon financial markets for low-carbon economic development has injected newvitality, and gradually become the world to seize the commanding heights of thedevelopment of a low carbon economy secret weapon. Financial services in the legalsystem of carbon emissions trading has been born. In order to seize the high ground, tosolve the Chinese legal system construction of low-carbon financial problems becamethe focus.Energy and environmental issues have become a prominent problem in China’seconomic development problems, and low-carbon economy, it can be a good solution tothis problem, we can solve high-emission facing China’s economic development, highpollution, high energy consumption; on the other hand, can promote the transformation and upgrading of China’s industrial structure. However, the development of low-carboneconomy requires strong financial support, financial support has become necessary, butif there is no financial support for the legal system to protect low-carbon economy, then,to achieve development and industrial upgrading and transformation of low-carboneconomy will become empty. Through the use of a comprehensive analysis of GM,summarized, a variety of methods, such as literature research, financial supportlow-carbon economy legal system more comprehensive analysis of the existing legalsystem, low-carbon finance research at home and abroad, to find out in our countryinadequate legal aspects of carbon finance, mainly low level of existing legislation, theeffect is not strong, many of the provisions in principle, lack of interoperability; at thesame time,learn the advanced experience from foreign countries, such as supporting thelegal aspects of Japan’s "low-carbon investment promotion law,"the US" low-carboneconomy bill "and explore feasible path of carbon finance. From the perspective ofcarbon finance law to analyze the current situation at home and abroad, while in China’sbasic national conditions as a starting point,to design and build a comprehensive,coordinated and sustainable development as the guiding philosophy, fairness, ecologicalpriority, both government regulation and market mechanisms for carbon finance basicprinciples of the Basic Law has laid a solid foundation for the rapid development ofChina’s system of carbon finance.
