Research On The Legal Issues Of Sound Mark

Trademark is the mark which hosts corporation reputation and disseminates corporation culture.It links businesses and consumers closely.When Two-dlmension mark can’t assistants companies to got the target market, new types of trademarks was emerged, sound mark is one of the new types of trademark.Through stimulus that giving by sound trademark, customs can clearly distinguish goods or services from one to anther in informational epoch. A new demand for law protection system of sound mark was proposed while the sound mark was included into trademark protection.Sound mark is the main subject in this paper, based on the previous studies and consultation of the related rules of sound mark in other countries and regions.The research argued from the definition of sound mark and probe the registration system, expression, protection status.In the end, the author proposed the corresponding views to complete the protection system of sound mark.Four aspects contained in the Paper are as follow:In the first part, the author introduced the concepts of sound mark, and analyzing the meaning and the development process of sound mark. the characteristics and advantages of sound mark and several related conception were discussed in this part.Comprehensively, the author analyzed what the sound mark is and make the start of the following part.In second part the author pointed her own view of sound mark legislation.According to the applied registration rules in Trademark Law of China. The author proposed that two conditions shall be included in sound which are the significance and recognition.In addition, the negative conditions was raised in this part.By telling different expressions and acquisition modes of other countries, the author proposes that our country should adopt a mixed expression, that is using a combination of registration and get-acquisition mode.By the time, the author put forward the kinds of sound mark infringement.In the third part, the author focused on the status of sound mark protection and analyzed the legislative protection and protection barriers.A comprehensive range of issues discussed at the beginning of the sound trademark protection which give theory support for finding the solutions. Aiming at find the solution for the previous problem, the author raised kinds of insights for the system of sound trademark protection in the last part.The author proposed the improved views from the aspects that reformed the examination procedure, established the information management efficiently and developed the current registration environment.
