Civil servants as the subject of the rule of law, the exercise of public power entrusted by the people to manage state affairs. The establishment of the civil service system of our country, is the result in order to adapt to the development of the socialist market economy and reform of the cadre and personnel system in our country. Especially in January 1,2006,“civil law” of the people’s Republic of China formally implemented,marking China’s civil service management to scientific,legal development, focusing on the establishment of a high-quality, professional civil servants. But because of the civil service system of our country is still relatively young, together with the influence of traditional thought, the related system is still not perfect.This paper is in such circumstances, inspired by the party’s mass line of educational practice, the high-pressure anti-corruption situation, in-depth thinking on China’s civil service administrative system of discipline, the use of comparative research, theoretical research and case analysis method, through to the domestic and foreign research status of interpretation, on how to improve the civil servants in our country suggestions on administrative system.Civil service administrative system connotation, refers to the state organs of civil servants management, illegal but exempted from criminal punishment of civil servants, to give a certain punishment, warning and relief of a series of laws and regulations, system.With the only subject, the object of punishment punishment in particular, the disciplinary function of dual and discipline to education four characteristics, the general theory of it is the public service theory, rights theory and the theory of rule by administrative law.China’s civil service administrative system has experienced the establishment, tortuous development, damage, recovery and development, the new development process, although compared with the past has been improved to some extent, but in the discipline four type,form, procedure, relief procedure problems, need to be further improved.In order to learn the foreign civil servant administrative system experience of civil servant administrative punishment system are described in detail. The foreign civil servant administrative system has five characteristics: the faith to the law more than the external constraints of discipline, discipline organization forms, track and provide adequate protection of rights and interests, the disciplinary procedures with the tendency of "justice", the enlightenment to our country: the civil service administrative system inChina should be highly standardized, establish a relatively independent of the civil service disciplinary relief agencies, punishment should be diversified in form, the program should be further improved, "the trial of the disciplinary procedures".The violation of civil law discipline, but also pay more attention to the protection of the legitimate rights and interests of civil servants, which is the starting point and the foothold of the article. How to improve China’s civil service administrative system, gives four suggestions to the innovation. The sound of our civil servant administrative categories, strengthening legislative protection; to enrich our civil service administrative,multi-pronged approach to strictly adhere to our country civil servants; administrative procedures, accept the supervision of the public; to perfect our country’s civil servant administrative remedy system, guarantee the legal rights and interests of civil servants.This paper based on the status, problems and reason analysis of China’s civil service administrative system of discipline, and put forward feasible methods to improve the system, so as to deepen the discipline connotation, continue to pay attention to protect the legitimate rights and interests of civil servants, harmonious party masses relations,strengthen our civil service team construction, consolidate the ruling foundation of governance.
