Research On The Applicable Law Of Life Insurable Interests

Interests of the insurance provisions in China’s "law of insurance" is too vague, and not be insurable interest in life insurance and property insurance interests and distinguish. In this paper, the origin and development of insurance interest, defines the concept of insurable interest in life insurance, the insurable interest of the general function and social function are discussed. At the same time, based on the summing up and analysis of the UK, America and Taiwan District of our country law and scholars point of view, combined with the characteristics of life insurance contract itself, different views of two main problems involved in personal insurance interest is the subject of insurance interests effectiveness and existing point analysis finally, the only beneficiaries should be insurable interest constraints and should be based on the source of insurable interest in life insurance, the insurable interest is the point made the difference between the provisions of the view. And then points out the deficiency in our country’s life insurance legislation, a series of problems puts forward corresponding perfect regulations of insurable interest in the proposal, in order to compensate for China life insurance interest in a certain extent.
