The Problems Occurring In The Process Of The System Of Community Correction And The Corresponding Suggestions

Since the Notice on Carrying Out the Pilot Work of Community Correction issued by the Supreme People’s Court, the Supreme People’s Procuratorate, the Ministry of Public Security and the Department of Justice in July 2003, a series activities of formulating laws and regulations have been carried out at the national and ministerial level to ensure the smooth conduct of the community correction work. the Criminal Law Amendment(eight) passed in 2011 puts “the community correction” into law form, which indicates that Chinese community correction work has entered the field of law, laying the legal foundation for the implementation of community correction work, and embodies that our country takes the community correction work seriously.From pilot to full implementation, the community correction work has obtained comprehensive and rapid development on the whole, the objects are constantly increasing, the content is constantly expanding and the system is gradually formed. In this process, the community correction work receives good results and accumulates rich experience for the following work of the community correction in the new period. Years of working practice shows that community correction work has positive effect on many aspects, such as the aspect of reducing the crime rate and the penalty cost. However, it also emerges a lot of problems. There are still some places are not so good and need to be improved at the operational level, if not timely resolved, it will inevitably has adverse influence on the subsequent development of community correction.This paper takes Tonglu County, Zhejiang Province as a model and combines the relative documentation of literature to form the regional empirical studies. By case study, such as describing and researching the basic information, correction mode, the execution system and the achievement of the work, to analyze the existing problems in the legislation of community correction, the use of community correction, the department cohesion in work, the judicial enforcement system and the working performance. After that, offer some corresponding suggestions and measures, hoping that can provide some effective support and reference for the future community correction work and the promulgation of the Community Correction Law in the future.
