Research On Several Issues Of The Establishment Of Specialized Intellectual Property Court In China

On August 31, 2014, the tenth meeting of 12 th standing committee of the National People’s Congress have passed a bill called "the decision of establishing intellectual property courts in Beijing, Shanghai, Guangzhou". And then, these three courts established their own intellectual property courts successively. This means intellectual property court have officially came into practice from theory. It’s also a big and significant step, as well as a milestone for our country’s intellectual property judicial reform. However, the establishment of Beijing, Shanghai, Guangzhou’s Intellectual Property Court, after all, is only regional unity, It is still difficult to achieve nationwide consistency at present. We need to learn lessons from pilot reform and have a further research from papers to know how exactly to proceed the establishment of intellectual property court in the future. In this paper, we will discuss the specific IP judicial practice in china, comparing the IP trial institutions in other country, in order to make sure the direction of establishing specialized intellectual property in our country and come up with a specific idea of establishing this intellectual property court with the help of our country’s experience.Of course, for the intellectual property dispute settlements, we must first clear the necessity and feasibility of the establishment of specialized intellectual property court. We will put emphasis on such themes——settlement of judicial confliction, the type of accepted cases, the trial mode of cases, solutions of technical problems, selections and training methods of relevant professionals involving the legal amendments and secret protection.
