In recent decades, along with the development of China’s economy and society, the rapid growth in the number of motor vehicles not only provides the shortcut and convenience to the human being, but also brings those traffic safety issues such as traffic congestion, accidents and environmental degradation. They have seriously affected the sustainable development of society and threatened the people’s life and property safety. As the main activities and root cause above the operation of transportation system, it has become a major practical issue for every participant that how to reduce the incidences of traffic violations and ensure traffic safety by effectively restricting drivers’violations of traffic laws and regulations and enhancing the traffic effectiveness.This study, with rational choice institutionalism as theoretical perspective, lays the stress on the analysis of the drivers’behaviors in the highway accidents. It treats the drivers as "rational economic man", and with this basic premise of assumptions, it analyzes the driver’s psychological needs and motivations and explores the impact of the traffic regulations, the ways to implement the provisions to regulate driver behaviors and the problems caused in this regulation implementation processes. Meanwhile, benefiting from the tradition of institutional innovation of rational choice institutionalism, this study tries to offer some solutions to the problems raised in the highway traffic safety administration and promote the innovative research on improving driver behavior regulation from the perspective of system construction.
