The rapid development of economy, environmental pollution is an increasingly serious problem, then the human not only trade the environment for economic, more of us pursuit of green environmental and natural resources for energy. Nuclear energy as an emerging energy, just to meet human needs for environmental protection, economy, won the praise highly of more and more countries. Since 1954 June, the world’s first nuclear power plant Built in the Soviet Union, Nuclear energy has become the main force of the output energy, the output energy. For example: the French nuclear power accounted for power supply of 75.2%, South Korea accounted for 34.8%, Japan accounted for 28.9%, Germany 26.1%, America accounted for 20.2%. But in nuclear power operation process, once the occurrence of a nuclear accident, the impact is devastating, destructive. Therefore we should explore is how to ensure the safety of nuclear power utilization problems. This paper will discuss is before the nuclear operations, during the operation, after the nuclear accident, the rights and obligations of international legal principles and provisions of international treaties to determine how the constraint nuclear operators and relevant national and international organizations, And make clear their respective responsibilities, combined with the actual situation in China, analysis of the current situation and deficiency of nuclear energy in China legal system, and gives some suggestions on how to improve, so as to provide guidance for practice.
