Domestic violence exists widely in the world, which infracts personal rights and property rights of victims seriously, it affects their physical and mental health, the happiness of the family and the social stability, so, we need a system to prevent Domestic violence urgently, to reduce the rate of Domestic violence. Habeas corpus comes into being.The main purpose of habeas corpus is to protect the victims, make the abuser and victims isolated before more serious results appeared, protect personal rights and property rights of the victims comprehensively, make the abuser realize the importance of family, then Domestic violence will not carry on any more, return to normal family life. Because of good social effects, Habeas corpus has become the main way of many countries to prevent Domestic violence. The provisions of the prevention of Domestic violence are in Criminal law and Marriage Law in China, and until now, China has not have the system of habeas corpus, faced the more and more serious situation, it is necessary to bring habeas corpus to China.There are five parts:The first part is the summarization of domestic violence and habeas corpus, the introduction of the origin and the result of habeas corpus.The second part is the summarization of habeas in America, England and Taiwan, the introduction of their generality and character, based on the advantage of habeas corpus, put forward the advice that suit for our country.The third part is the introduction of the style, applicant, kind, execution and responsibility of habeas corpus.The forth part is to introduce the feasibility of habeas corpus and to devise habeas corpus in our country.The fifth part is the analysis of the feasibility and advice of habeas corpus in our country.
