On The Building Of Punitive Damage System Of Copyright Infringement In China

In the area of intellectual property protection in China, punitive damages system has been established in the protection of patent right and trademark right. For the purpose of strengthening the protection of copyright, this article uses certain foreign states’ relevant systems and regulations as reference, and bases on the situation of China, then proposes suggestions on the establishment of punitive damages system in the area of copyright protection in Chnia. This article altogether is divided into four chapters:The first chapter is the summary of the punitive damage system. First explains the concept and function of this system and its historical development. And then analyses the relevant practice in China.The second chapter is the elaboration of the regulations and legal practice of punitive damage system in some countries,area and organizations, including World Trade Organization, the United States of America, Germany, Japan. This part mainly analyses their relevant systems in the protection of copyright.The third chapter is the research of the necessary of establishing punitive damage system, mainly focusing on the advantages of such system, including its adaptability in the area of China’s intellectual property protection, improvement in the level of protection of copyright and also the prevention function of infringement act.The fourth chapter, based on the above part, expounds the possible ways of drafting relevant clauses in the area of protection of copyright in China.
