With the development of the social market economy and diversification of social benefit in China,the conflicts between different stakeholders are increasing. Large of contradictions and disputes swarm into courts have led to the stress from judging.Reflecting the history of our country after founding state,the progress of court Mediation System(CMS) has experienced the process: focus on mediation(before 1982)——emphasizing mediation in 1982 —voluntary and lawful mediation in(1991)——emphasizing mediation(2003) —mediation to possibility(2005)—giving priority to mediation and combining mediation with sentencing(2010) —priority mediation(2012).Although these principles played a positive role on solving various disputes and contradictions, there are also obvious limitations. That is totally significant on building a diversified solving system which could link up and effectually Combination of the solution of civil disputes which are complicated and extensive in the society contribute to establishing a high-quality environment to maintain build a harmonious society. To established a part of fictions ststems and the effects on diverse dispute resolution’s combination is extremely vital.. As the system doesn’t formulate the combination of litigation and Mediation(CLM) in the legislations distinctly.This dissertation begin from the definition and sources of CLM, study and compared with relative extraterritorial legislations. Deeply studies the existing problem in the CLM for civil litigation of china.The individual suggestions for perfecting CLM have been provided in the article as well.I hope that this study could be useful for improving the evolution of CLM.
