The Substantive And Procedural Standards Of Preliminary Injunction In Intellectual Property

This paper focuses on the preliminary injunction in intellectual property in our country. The case of Jia Duo Bao was used to analyze the issues in preliminary injunction. Some American cases and rules on preliminary injunction is also introduced so that there is an international comparison in the analysis. Finally, some suggestions on how to improve the rules are given.The first part is on the current rules on preliminary injunction in intellectual property. Introductions on statutes and legal practice are given separately.The second part is on the case of Jia Duo Bao. It discusses the major issues in the case and the effects on the rules of preliminary injunction.The third part is on the comparison between the rules in US and China. It explains the reason of difference and introduces some rules that may be useful in our country.The forth part is on the suggestions to our current rules on preliminaryinjunction in intellectual property.The fifth part is the conclusion.
