| It should be noted that the majority of “tongqi”(women who are married to homosexual males), were unaware of their husband’s sexual orientation when they got married. As heterosexuals, they suffered great agony in their dysfunctional marriage. Their rights as a spouse have been greatly infringed by their husband; however, their legitimate rights and interests are not protected because there are no specific working laws in our legislation. Although the legal status of “tongqi” has not been clarified and confirmed, the dilemma of those women deserves legislative concern. Adjustments should be made to the Marriage Law, improved regulations are needed in the fields of marriage annulment and divorce compensation, and certain preference should be shown to the women married to homosexual males when it comes to custody and property distribution. Furthermore, legislation about homosexual and the promotion of unbiased treatment of homosexuals are in urgent need. Only when all-rounded protection is guaranteed can “tongqis” step out the maze and embrace a bright future. |
