Research On Liability For Damage Of International Space Station And The Consideration Of China’s Space Station Legislation

Subjects investigated of the thesis are international and domestic legal norm and legal systems of liability for damage of International Space Station, and outer space law as the research perspective. The thesis conducted based on normative analysis and contrast analysis methods, meanwhile, it strives to set an example to China’s legislation.There are two levels of legal framework involve liability for damage of ISS, international level and domestic level. The treaties of outer space provide important basis and reference system to the construction of damage liability system, The International Space Station Intergovernmental Agreement and memorandum of understanding between the government s have richened the liability system, and they become important innovations and complementarities of the international legal framework. On the basis of the international legal system, the relevant domestic laws of main space powers considering their own national conditions, the creative legal systems are more practically significant.With the development of China’s space science and the enhancement of the comprehensive national strength, China has gradually participated in the construction of Space Station, China have to face the problem of damage of the station. As for China’s space station legislation, it should consider about the status of China’s domestic law of space station, it is necessary that China need to construct the system of damage liability from following five aspects: subject, doctrine of liability fixation, methods of bearing liability, approaches to compensation and insurance, so that can China reduce the losses of space activities, ensure the normal operation of the space station, and finally realize the goal for the wellbeing of mankind.
