Research On Freedom Of Speech In We Media Age

With the rapid development of Internet technology and mobile terminals, China began to step into the We Media age. The appearing of We Media has an important significance to freedom of speech in the constitution. It not only provides a wider platform for the expression, but also promotes the position of citizens’ comments, enriches the way of expression, and promotes the realization of citizen’s oversight role in the social supervision. However, there are various problems in the exercise of We Media’s right of speech, for example, the coverage of speech is narrow, the degree of speech is shallow, the way of speech is incorrect, and the security and regulation of freedom of speech is not perfect. It is not only harmful to the realization of free speech, but also causes unnecessary legal disputes, which damages to other civil rights and public profits.The problems of We Media’s freedom of speech result from many reasons, such as society, police, the law and We Media’s own reason. External factors mainly including the fickleness of social mentality, the anomie of morality, the lagging of the constitution and the absence of special laws, the excessive control of the government and the absence of supervision. Internal factors mainly including the misreading of constitutional spirit, the lack of consciousness of constitution and awareness of rights, the inherent disadvantages of the psychology of social group, and the lack of media literacy.In order to solve the problems of We Media’s improper exercise of free speech, and fully realizes the value of freedom of speech, we should further safeguard and regulate We Media’s freedom of speech. We should improve We Media’s consciousness of constitution and awareness of rights, enact special laws and build a checklist of negative behaviors, perfect the judicial interpretation, improve the censorship in media and explore diversified management modes. At the same time, the government’s emphasis on We Media supervision and the education of citizen’s media should be strengthened, too. Only depends on these measures, We Media’s rights of expression can be preserved, the way of We Media’s expression can be justified, and the value of free speech can be realized.
