Legal Regulation Study On Illegal Ambulance

The rapid development of economy and society has brought social phenomena emerge in an endless stream.New social problems can’t be regulated and protected by current law Because of the lag of legal system.In recent years,some illegal ambulance behavior occurs in many areas of China.Some actors for the pursuit of economic interests to ignore others health, pose a threat to others personal and property safety.This phenomenon showed the current research on this problem in law of China,especially the definition of criminal law on some crime, as well as the coordination of different departments in judicial practice is not enough.This paper discusses the phenomenon of illegal ambulance, analysis its impact to society.According to the characteristics and causes of illegal ambulance, conclude types of crime in this phenomenon,discuss the identification problem of theirs.Before this year,there has not uniform standard,and also has not perfect system on this problem in law of China.In February 1, 2014, the National ministry of public health promulgated the "measures for the administration of the people’s Republic of China emergency pre hospital", which makes up for some problems in a certain extent,but it’s also has some defect.This paper also discusses the limitations of the new law,fusion of each department law, constructs the complete system.The full text is composed of exordium, chapter 2-5 and conclusion.The exordium mainly introduced the background of illegal ambulance,and the legal regulation of China’s pre hospital emergency, pointed out the significance of this article.Chapter 2 is a summary of illegal ambulance.This chapter consists of four sections,the concept and status,the behavior,the characteristics and the causes of illegal ambulance.List some cases,establish a comprehensive understanding of illegal ambulance,lay the foundation for the next study.Chapter 3 is how to regulation the illegal ambulance on administrative law and civil law.This article mainly from the angle of this two departments of law,administrative,to talk about the defect in this phenomenon on “Contract Law”,”Tort law”,”Traffic law”,”China Public Order Management Law”and so on.Chapter 4 is how to identified the accusation of this behavior.According to the criminal acts such as Homicide,Mayhem,The crime of illegal medical practice,The crime of illegal business operation or Robbery in illegal ambulance process,discusses the problems in identified.Chapter 5 is countermeasures of manage illegal ambulance.This chapter from the follow three parts to provided the solution about the illegal ambulance.Improve the existing law,Establish the “pre hospital emergency law”,Marketization pre hospital emergency.The last part Summarizes the full text.
